Chapter 13 Bankruptcy in Georgia

A plan for catching up and moving forward.

Who Chapter 13 may help

Chapter 13 may help people with regular income who need time to catch up on mortgage or vehicle payments, address debts through a repayment plan, or explore an alternative to Chapter 7. Eligibility and the treatment of your property depend on your circumstances.

How long it takes

A Chapter 13 repayment plan generally lasts three to five years. Plan payments generally begin within 30 days after filing, even before confirmation. A discharge follows completion of the plan and other requirements. Timing and outcomes vary.

Gather pay records, tax returns, bank statements, household expenses, mortgage and vehicle statements, insurance information, a list of debts and assets, and prior bankruptcy information.
